Terms of Use

Bid on Plants offers a free membership based on trust.  Follow our Rules put forth in the Terms of Use section.  BOP reserves the right to suspend membership for any reason.  If a membership is terminated this will include a lifetime ban and the member will not be able to rejoin bidonplants.com for any reason.  We will do whatever it takes to keep BOP a safe and fun place for auction and trade.  Placing a bid is a legally binding contract.  Make sure you are certain you can pay before placing a bid.

Membership termination could happen due to:

Fraud – BOP has a zero tolerance policy for fraud and will prosecute if deems necessary to uphold the Law.

Fraudulent User Information– It’s against the law to make a bid with a fraudulent name or credit card.

Bidding with no intent to buy– Placing bids and not paying for the item after winning is against BOP’s policy.

Mail Fraud– After paying for an item, then not receive the merchandise -or- receive something other than you paid for.

Bid Shilling and Shielding– Bid shilling is when an individual schemes with someone else or creates a false identity in order to drive up the bidding prices for the seller. Bid shielding is when a buyer and partner artificially inflate bids preventing other bidders from bidding. Then, at the last minute, the shielding user cancels their high bid whereby his/her partner wins the auction with a lower offer.

Falsified Feedback– We understand Mistakes happen, report them the right way before leaving Feedback through our ticket system to try and resolve first.  Leaving False or Misleading Feedback for any reason is unacceptable.

Further, we can (and you authorize us to) disclose any information about you to law enforcement or other government officials as we, in our sole discretion, believe necessary or appropriate. Therefore, although we use industry standard practices to protect your privacy, we do not promise, and you should not expect, that your personally identifiable information or private communications will remain private.

Bid On Plants does not allow any user information, feedback, usernames, identity of usernames, etc, to be displayed in any public lists. If any users has been found to publish such list, they will be immediately terminated from BOP.

The terms applicable to the Email This Auction to a Friend service apply to your use of that service. Without limiting the foregoing, you may not use the service to send spam. Further, such prior information is never completely removed from our databases due to technical constraints and the fact that we back up our systems. Therefore, you should not expect that all of your personally identifiable information will be completely removed from our databases in response to your requests. You must promptly update your information if it changes.

Bid On Plants uses industry standard efforts to safeguard the confidentiality of your personal identifiable information, such as firewalls and Secure Socket Layers. However, “perfect security” does not exist on the Internet.

About BidOnPlants

BOP is an auction site that allows users to offer, sell and buy plants and seeds in a variety of pricing formats and locations. The actual contract for sale is directly between the seller and buyer. It is the seller’s responsibility to know their state and national laws on the sale of plants and seeds. Buyers must know what plants and seeds are able to enter their locality.  BOP is not responsible for any plants shipped under a quarantine; regulations on specific species; state and national laws broken by a seller or a buyer.

While we may provide pricing, shipping, listing, and other guidance in our Services, such guidance is solely informational and you may decide to follow it or not. Also, while we may help facilitate the resolution of disputes through various programs, BOP has no control over and does not guarantee the existence, quality, safety or legality of items advertised nor the truth or accuracy of users’ content or listings; the ability of sellers to sell items; the ability of buyers to pay for items; or that a buyer or seller will actually complete a transaction or return an item.

Because user authentication on the Internet is difficult, the BOP cannot and does not confirm that each user is who they claim to be. Therefore, because you must be careful in dealing with other users to avoid fraud, we have established a user-initiated feedback system to help you evaluate who you are dealing with. We encourage you to communicate directly with a trading partner to help you evaluate with whom you are dealing. We reserve the right to terminate or ban any user without consent so that we may help to provide a trustworthy trading community.

Our services are available only to individuals who can form legally binding contracts under applicable law. Without limiting the foregoing, our services are not available to minors. If you do not qualify, please do not use our services. Bid On Plants may refuse our services (such as, but not limited to listings, messaging and bidding) to anyone at any time, in our sole discretion. Once a bid is placed whether it is the first bid or final bid, it is considered a legal contract to purchase an item.  Bids do not get retracted as it is the user’s (Buyer) responsibility to hold up their end when submitting a bid.  Members are to pay promptly and follow the directions of described items.  Seller’s are held to the standards they set forth in their descriptions and are to ship items on time, as promised. BOP reserves the right to terminate or ban any user if deemed necessary for the health of the site and the safety of the members.

It is a violation of the law to make a bid using a fraudulent name or credit card number. Fraudulent bidders will be prosecuted to the fullest extent of the law. We will do whatever it takes to keep BOP a fair and honest trading site.

If the user has an issue they will utilize the email ticketing process to file a complaint.  We will work with both parties upon a dispute to try and resolve the matter before any legal action would occur.  BOP is merely the platform to use during auction and trade and expects its users to abide by the rules and resolve any issues amongst themselves.  BOP is a 3rd party overseeing and will only become involved in a matter as last resort effort to resolve a dispute before any legal action would be taken.
